Terms of Service

1. Subject and Scope

1.1. Codenga Services (“Services”) are operated by:

Poland (thereafter “Codenga”, “we” or “us”).

1.2. Your use of the Services is subject to the following Terms and conditions.

1.3. By accessing or using any part of the Services, you accept the application of these Terms and conditions.

1.4. Codenga may amend, change, or update these Terms. You can review the most current version of the Terms of Service at any time here: https://codenga.com/pages/terms_of_service. Your continued use of the Services after any such changes have been made constitutes your acceptance of the new Terms of Service.

2. Services and Rights

2.1. The Services allow you to purchase and use a variety of coding classes (“Products”).

2.2. The scope of the Services may depend on the type of Product you have purchased. The description of features associated with a Product is available via the Services.

2.3. Subject to and in accordance with these Terms, Codenga grants you a limited, non-transferable, non-sub-licensable, non-exclusive, revocable license to make personal, non-commercial use of the service, including any Products purchased by you.

2.4. All Content available through the Services, including audio, designs, graphics, images, information, software, text, and other files as well as their arrangement and selection are the proprietary property of Codenga or its licensors. You may not copy, distribute, display, download, post, reproduce, republish, scrape, sell, or transmit, in any form or by any means, in whole or in part, other than as expressly permitted in these Terms.

2.5. You may not derive or attempt to derive the source code of any part of the Services, permit any third party to derive or attempt to derive such source code, or decompile, disassemble, reverse engineer, or translate the Services or any part thereof. Codenga and its licensors own and shall retain all intellectual property rights and other rights in and to the Services and any changes, modifications, or corrections thereto.

2.6. Codenga may change, update, suspend, make improvements to, or discontinue any aspects of the Services.

3. Account

3.1. To access and use some parts of the Services, you are required to create an Account (“Account”).

3.2. You may use your email address along with a self-determined password to create an Account. By providing Codenga your email address you consent to us using the email address to send you Services related notices

3.3. You are required to maintain the confidentiality of your password and other information related to the security of your Account. You must notify Codenga immediately of any breach of security or unauthorized use of your Account. Codenga will not be liable for any losses caused by any unauthorized use of your Account.

3.4. You agree to provide accurate, complete, and current information about you as requested by Codenga. You agree to update such information, as needed, to keep it accurate, complete and up-to-date. If you don’t, Codenga may suspend or terminate your Account

3.5. You are responsible for access to and control of your account, and for all activities that occur under your account or password. You should not reveal your account information to anyone.

3.6. You have the right to terminate your Account at any time using appropriate tools provided by the Services. Termination will result in an irreversible removal of any Content (“Content”) and Products associated with your Account.

3.7. A termination of the Account will become effective the day after the termination was requested by you.

4. Content

4.1. By creating, storing, or submitting any images, information, reviews, questions, source code, text, translations, or other materials through the Services, you grant Codenga an irrevocable, non-exclusive, perpetual, royalty-free, transferable, and worldwide license to copy, create derivative works from, display, distribute, excerpt, reformat, reuse, and translate such Content for providing the Services as well as personalizing your experience of and promoting the Services and you acknowledge that you cannot terminate this license after creating, storing, or submitting the Content.

4.2. You are responsible for the Content you create, store, or submit. You agree that any Content that you post does not and will not violate third-party rights of any kind.

4.3. You warrant that you will not create, store, submit, or otherwise provide on or through the service any Content that:

- is abusive, harassing, hateful, offensive, threatening, or otherwise violates any law or infringes upon the rights of any third party (including copyright, privacy, publicity, trademark, or other personal or proprietary rights);

- in Codenga's sole judgment, is explicit or objectionable, damages, exploits, or otherwise impairs the Services in any way;

- or may expose Codenga or any third party to harm or liabilities of any kind.

4.4. Codenga monitors Content created and stored through the Services and reserves the right to remove any Content that is considered inappropriate.

5. Purchases and Fees

5.1. To purchase a Product you must pay a Fee (“Fee”) at the price listed on the service for that Product.

5.2. Fees for purchasing Products are subject to change at any time, with or without notice, and without liability to you or any third party.

6. Refunds

6.1. If you're not satisfied with the Product you purchased within thirty (30) days after purchasing we may issue a refund at our sole discretion. We reserve the right to deny you a refund if you have consumed more than thirty percent (30%) of the Product that you want to refund. We also reserve the right to deny you a refund if you used the tools available in the Services to clear the progress of the Product (Course Schedule) that you want to refund.

6.2. If we ban your Account or disable your access to a Product due to your violation of these Terms, you will not be eligible to receive a refund.

6.3. To request a refund you are required to send an email to support@condega.com explaining the reasons for your request.

6.4. Refunds are returned via the original payment method.

7. Community

7.1. Depending on the Product you purchased you may be entitled to take part in the Community forum (“Community”) associated with the Product. By taking part in the Community you agree that Codenga has a right to remove any Content that violates these Terms.

8. Limitation on Types of Damages and Liability

8.1. Services are provided on an "as available" and "as is" basis. Codenga is not able to promise that your use of Services will be error free.

8.2. Codenga is not responsible for any loss or damage that is not reasonably foreseeable.

8.3. For the Products you purchased, Codenga's liability is limited to the Fees paid.

9. Privacy

9.1. Your use of the Services is governed by a Privacy Policy (https://codenga.com/pages/privacy_policy). By using the Services, you consent to the terms of the Privacy Policy.

10. Miscellaneous

10.1. If one provision of these Terms and conditions shall be deemed as void, the remainder of the Terms and conditions shall remain in full force. If applicable, the void provision shall be replaced by the statutory provisions.

10.2. Polish law will apply to all disputes and the interpretation of these Terms of Use. The Polish courts will have non-exclusive jurisdiction over any dispute arising from or related to your use of the Service.
